Dictionary:

Data - personal data within the meaning of the Act of August 29, 1997 on the protection of personal data;
Working days - days from Monday to Friday, which are not public holidays;
Customer – a person making purchases in the Store;
Consumer – a natural person performing a legal transaction not directly related to his or her business or professional activity;
Customer Account – account on the Website;
Regulations - these regulations specifying the conditions of use of the Website;
Website – website of the Adrian Nowak store, located under the domain name adriannowak.com
Store – online store operating at adriannowak.com , run by the Seller;
Seller - ADRIAN NOWAK ATELIER, NIP: 6562277767, based in Kraków, ul. Ślusarska 8/130, 30-710 Kraków.
User – a natural person, a legal person or an organizational unit without legal personality that uses the Website;
Registered User – User who has a Customer Account.


ORDER

1. Goods can be ordered as follows:

  • using the "add to cart" option; To do this, you must add the goods to the cart using the "add to cart" option, provide address and contact details, select the delivery and payment method, and then the "place order" option.
  • by sending an e-mail with your order to: adriannowak@icloud.com . In the e-mail, please provide the name, other options if any, method of payment and shipping address and telephone number. Within 1 business day at the latest (usually within a few hours), I will respond to your e-mail, confirm acceptance of the order and agree on the details of the transaction.

2. When ordering goods, the customer submits an offer to conclude a contract. After placing the order, the Customer will immediately receive an automatically generated message to the provided e-mail address confirming receipt of the order by the Store. The sales contract is concluded when you receive an e-mail from the store informing you that the order has been accepted for processing. This message is tantamount to the Seller's acceptance of the offer submitted by the Customer. The customer should receive information about the acceptance of the order for processing no later than 2-3 business days after placing the order - otherwise the customer is no longer bound by the submitted offer.

3. In order to detect and correct errors in the entered data, detailed order information is displayed in the form of a summary before the "Place order" option appears. This information includes the Customer's details, shipping address, list of ordered products with their quantities and prices, and selected payment and delivery method. It is possible to correct the provided Data yourself. To do this, select the "back" option and correct the data.

4. The customer has the option of canceling the placed order or making changes (modifications) to the placed order, provided that the declaration of resignation or modification is submitted before sending the goods by the Store staff. Information about sending the goods is sent to the Customer by e-mail. Cancellation or modification of the order can be made by sending a message via e-mail. Regardless of the right to cancel the order, the Customer who is a Consumer has the right to withdraw from the contract without giving a reason, on the terms set out in the Regulations.

PAYMENT METHODS

1. I accept the following forms of payment:

  • online transfer via the Przelewy24 platform - the seller immediately receives confirmation of the transfer
  • bank transfer directly to the store's account
  • in cash at the company's headquarters in case of personal collection of the product(s).

2. In the case of a transfer to a bank account, the goods will be accepted for processing/prepared for shipment after the payment is credited to the account. After accepting the order, I will send an e-mail with information about the account number and the amount to be paid.

ITEM AVAILABILITY

1. Product for which the "Add to cart" option is active:

  • is available and is in the store's warehouse - it is available immediately
  • its implementation time depends on the type of product that has been ordered.

2. If I am not able to complete all the goods included in the order that are immediately available, the Customer will be informed immediately about this fact. The customer then has the right to choose one of the appropriate options:

  • partial order fulfillment,
  • extension of waiting time,
  • canceling the entire order.

METHOD AND DATE OF SENDING OR RECEIVING THE GOODS

1. Goods are shipped within 2-3 business days of placing the order. This term counts:

  • from the date of receipt of the payment - when paying by bank transfer or credit card
  • from the date of receipt of confirmation of payment - in the case of electronic payment

3. It is possible to collect the order in person at the headquarters of ADRIAN NOWAK ATELIER at ul. Ślusarska 8/130 in Kraków. For this purpose, please contact us by phone: +48 505176660 . It is possible to make an appointment at the Atelier on the weekend or at other times. We sell our products on site - all those that can be ordered via the adriannowak.com website and others that are waiting to be "put into the store" are immediately available. In the stationary store you can pay in cash or by card.

PRICES AND BILLS

1. The prices of goods given on the Store's website are prices including all applicable taxes. These prices do not include shipping costs or any customs fees associated with sending goods abroad.

2. The Seller is not a VAT payer.

COMPLAINTS AND OUT-OF-COURT DISPUTE RESOLUTION

1. I make every effort to ensure that the goods offered in the store are of the highest quality. It is my responsibility to deliver items free from defects.

2. However, if it turns out that they reveal defects or non-compliance of the goods with the contract, please inform me about them via:

The customer is obliged to indicate the preferred method of handling the complaint. The same applies to irregularities in the functioning of the Internet Service. I respond to complaints immediately.

3. The seller is liable under the warranty if a physical defect is discovered within two years from the delivery of the item to the buyer. The buyer may submit a declaration of price reduction or withdrawal from the contract, unless the seller immediately and without excessive inconvenience to the buyer replaces the defective item with a defect-free one or removes the defect. This limitation does not apply if the item has already been replaced or repaired by the seller or the seller has not fulfilled the obligation to replace the item with a defect-free one or to remove the defect. If the buyer is a consumer, he may, instead of removing the defect proposed by the seller, demand replacement of the item with a defect-free one, or instead of replacing the item, demand removal of the defect, unless bringing the item into compliance with the contract in the manner chosen by the buyer is impossible or would require excessive costs compared to the method. proposed by the seller. The reduced price should be in such proportion to the price resulting from the contract that the value of the item with a defect remains to the value of the item without the defect. The buyer may not withdraw from the contract if the defect is immaterial. If the buyer who is a consumer has requested the replacement of the item or removal of the defect or has submitted a declaration of price reduction, specifying the amount by which the price is to be reduced, and the seller has not responded to this request within fourteen days, it is considered that the request was justified.

4. Failure to respond to a complaint submitted by the consumer within 14 days is tantamount to accepting the request contained in the complaint.

5. If, in connection with a justified complaint, it is necessary to incur the costs of sending the goods, they will be refunded by us. If it is necessary to return the goods to the Store or another place to consider the complaint, the Seller will inform the Customer about this. The Store does not accept shipments sent to the Store on delivery. If the complaint is deemed justified and the Customer submits such a request, the Seller will immediately refund the amounts received. In case of payment by payment card, the refund will be made to the card.

6. I inform you about the possibility of resolving disputes electronically using the EU online dispute resolution (ODR) platform. Link to the ODR platform http://ec.europa.eu/consumers/odr/ . The ODR platform will enable the entrepreneur to resolve a dispute with a consumer online, even if the consumer lives in another Member State and speaks a different language.

RIGHT TO WITHDRAW FROM THE CONTRACT (CANCELLATION OF PURCHASES)

1. You have the right to withdraw from the contract within 14 days without giving any reason.

2. The deadline for withdrawal from the contract expires after 14 days from the date of receipt of the goods. To exercise the right to withdraw from the contract, you must inform me of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by e-mail to the following address: adriannowak@icloud.com or by post to the following address: ADRIAN NOWAK ATELIER, ul. Ślusarska 8/130, 30-710 Kraków.

3. You can use the sample withdrawal form, but this is not obligatory.

4. In order to meet the deadline for withdrawal from the contract, it is sufficient for you to send information regarding the exercise of your right to withdraw from the contract before the deadline for withdrawal from the contract expires, i.e. before the expiry of 14 days from receipt of the goods.

5. In the event of withdrawal from this contract, I will refund to you all payments received from you, including the costs of delivering the goods (except for additional costs resulting from your chosen delivery method other than the cheapest standard delivery method offered by us), immediately and in any case no later than 14 days from the day on which I was informed about your decision to exercise the right to withdraw from this contract. I will refund the payment using the same payment methods that you used in the original transaction, unless you have expressly agreed to a different solution; in any case, you will not incur any fees in connection with this refund.

6. I may withhold the refund until I receive the item or until I receive proof of sending it back, depending on which event occurs first.

7. Please send back or hand over the item to us immediately, and in any case no later than 14 days from the day on which you informed us about your withdrawal from this contract, to the following address: ADRIAN NOWAK ATELIER, ul. Ślusarska 8/130, 30-710 Kraków. The deadline is met if you return the item before the 14-day deadline expires. You will have to bear the direct costs of returning the items.

Clothing must be in perfect condition (unused, unwashed, with original inner and outer tags attached, no traces resulting from trying on, e.g. traces of make-up or the smell of perfume, no repairs and confirmation of purchase).

I reserve the right to refuse to accept returns after the agreed deadline, or if the items are not in the same condition in which they were sent and/or if they do not meet the return conditions. Refunds may be withheld until we receive the goods or you provide proof of having sent them back.

PERSONAL DATA

1. Data provided by Users, including in particular name, surname, residential address, shipping address, e-mail address, telephone number, order information, will be processed in order to process orders. Providing this data is voluntary, but necessary for the Store to process the order. In the case of Users who have registered a Customer Account, the data will be additionally processed in order to create and maintain a Customer Account. The data of Users who have consented to this will be processed in order to provide them with commercial information regarding the Store's offer electronically.

2. Users have the right to access their Data, correct it and request its removal. Users who have registered a Customer Account have direct access to their Data via the Customer's administration panel.

3. The entrusted Data is protected in accordance with the Act of August 29, 1997 on the protection of personal data, in a way that prevents access by third parties.

FINAL PROVISIONS

1. The information posted on the website adriannowak.com does not constitute an offer within the meaning of Art. 81 of the Civil Code.

2. The contract is concluded in Polish.

3. These Regulations are available on the website adriannowak.com . Each User has the ability to independently access, copy and print the content of the Regulations at any time.

4. Information summarizing the content of the order is displayed on the adriannowak.com website in a way that allows it to be copied and printed, and sent to the Customer by e-mail. Regardless of this, the content of the placed order is recorded in electronic form in the Seller's IT system and protected against access by third parties, including: by using antivirus software and password protection.

5. Users are prohibited from providing illegal content.

6. For the proper functioning of the Website, you need a computer with access to the Internet, an updated web browser with software for Java Script and Java applets installed, Internet Explorer recommended; Firefox; Opera; Google Chrome; Safari, cookies enabled.
